Please read them carefully as they contain important provisions affecting your legal rights, obligations, and remedies, including limitations on liability and indemnification obligations. By accessing or using this website, creating an account, or using any services, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms, our Privacy Policy, and Refund Policy. If you do not agree to these Terms, you must immediately cease using our website and services.

General Terms of Use

By visiting and using this website, you acknowledge that you are bound by these Terms and applicable laws. Your access to and use of the services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the service.

NO GUARANTEE OF AVAILABILITY:

While we strive to provide reliable access, Verified.RealEstate does NOT guarantee uninterrupted, timely, secure, or error-free operation of the platform or services. We make NO WARRANTY regarding:

  • 24/7 availability or uptime of the website, mobile apps, or services
  • Timely completion of services or orders
  • Continuous availability of any feature, tool, or service
  • Compatibility with your devices, browsers, or systems

We reserve the unconditional right to:

  • Interrupt, suspend, restrict, or terminate access to the platform or services at any time, for any reason, without prior notice or liability
  • Perform maintenance, upgrades, security patches, or modifications with or without notice
  • Modify, discontinue, or remove features, services, or content
  • Limit access during periods of high traffic or system stress
  • Block access from specific IP addresses, regions, or user accounts

ZERO LIABILITY: We shall have ABSOLUTELY ZERO LIABILITY for any loss, damage, inconvenience, or consequences of any kind caused by platform unavailability, service interruptions, downtime, maintenance, upgrades, modifications, or termination of services, regardless of cause.

Third-Party Dependencies: Our platform relies on various third-party service providers including payment gateways, AI services, cloud infrastructure, database providers, communication platforms, authentication services, and project management tools. WE HAVE ZERO LIABILITY for their availability, performance, failures, delays, interruptions, security breaches, or any actions or omissions by any third-party service providers.

YOU USE AT YOUR OWN RISK: You acknowledge and expressly agree that your use of the platform and services is at your sole risk and that you assume all risks associated with platform availability, performance, and third-party dependencies.

We reserve the right to update or modify these Terms at any time. We will notify users by posting updated Terms on the website and revising the "Last Updated" date. It is the responsibility of users to regularly review these Terms. Continued use of our services after any such modifications constitutes acceptance of the updated Terms.

Services Overview

Users can browse and list properties available for sale, rent, or lease. All users listing properties must ensure that the information provided is accurate, up-to-date, and complete.

We provide architectural design services for residential, commercial, and industrial construction projects. All services are based on the information provided by the client. Design services may involve additional consultations and revisions based on the project’s complexity.

Our property management services encompass a range of tasks, including but not limited to collection and payment of utility bills, coordination of licenses, regular maintenance checks, and more.

Our escrow services are designed to ensure secure and transparent real estate transactions. Verified.RealEstate will act as a neutral intermediary in holding the funds until all terms of the agreement are fulfilled.

We facilitate leasing and renting office spaces across Chennai and Tamil Nadu. Users are encouraged to conduct their own site inspections and due diligence before entering into agreements.

Our platform allows landlords to list residential properties for rent and assists tenants in finding rental spaces. Verified.RealEstate acts solely as an intermediary and does not take responsibility for lease agreements or tenancy disputes that arise post-listing.

We provide tools, calculators, and guidelines based on the principles of Vastu Shastra. These tools are for informational purposes only, and we do not guarantee any material or spiritual outcomes.

We offer specialized real estate services for Non-Resident Indians (NRIs) to manage their property-related affairs, including purchase and sale of properties, tenant management, payment of utility bills and taxes, and security services.

Registration, Accounts, and User Conduct

Users may need to create an account to access certain features and services. During registration, you agree to provide accurate, current, and complete information.

We reserve the right to suspend or terminate accounts at our discretion if users violate these Terms or engage in any activity that is deemed illegal, fraudulent, or harmful to the platform or other users.

Users may not post false, misleading, or inaccurate property listings, use the platform for illegal activities, distribute spam, or infringe on intellectual property rights.

Payment Terms

All service fees and pricing are clearly disclosed at the time of engagement of services. Users are required to pay all applicable fees promptly. Refunds are offered under specific circumstances outlined in our refund policy.

We accept payments through credit/debit cards, bank transfers, and integrated third-party payment gateways. Users must ensure valid payment methods are used.

If payments are not made by the due date, Verified.RealEstate reserves the right to suspend services or charge late fees, which will be specified in individual service agreements. Users agree to be responsible for all legal fees, costs, and interest incurred due to non-payment or late payments.

Refunds are not offered unless explicitly stated for a particular service. For escrow services, refunds may only be issued if the agreement between both parties is voided before funds are disbursed. All refund requests must be submitted in writing within 14 days of the service in question.

Privacy and Data Usage

We collect personal data such as names, email addresses, and property information as necessary to provide our services. By using our platform, you consent to this collection.

We employ industry-standard security measures to protect your data. However, Verified.RealEstate is not liable for any data breaches caused by malicious attacks, negligence, or third-party failures.

We do not share personal data with third parties except for the purpose of providing services (e.g., payment processing, WhatsApp login integration via Plivo). For more information, please review our Privacy Policy.

Intellectual Property

All content, materials, tools, and services on Verified.RealEstate are the intellectual property of Verified.RealEstate or our licensors. Unauthorized use of this content is prohibited.

By posting content (such as property listings or reviews) on Verified.RealEstate, you grant us a worldwide, perpetual, royalty-free, and non-exclusive license to use, distribute, modify, and display this content.

Warranties and Disclaimers

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VERIFIED.REALESTATE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR:

  • Indirect, Incidental, Consequential, Special, Punitive, or Exemplary Damages of any kind, including but not limited to:
    • Loss of profits, revenue, business opportunities, contracts, or anticipated savings
    • Loss of or damage to goodwill, reputation, or business relationships
    • Loss, corruption, or unauthorized access to data or information
    • Cost of procurement of substitute goods or services
    • Property losses, transaction failures, or investment losses
    • Emotional distress, mental anguish, or personal injury (except where prohibited by law)
    • Losses arising from reliance on platform content, verification reports, property data, or third-party information
    • Losses from property defects, title issues, legal problems, encumbrances, or regulatory violations discovered or undiscovered
    • Losses from failed transactions, escrow disputes, service partner failures, or third-party misconduct
    • Losses arising from government delays, regulatory changes, or force majeure events
  • Any losses or damages arising from:
    • Use or inability to use the platform or services
    • Unauthorized access to your account or data
    • Errors, inaccuracies, or omissions in content, property data, RERA information, or verification reports
    • Platform interruptions, delays, errors, bugs, viruses, or security breaches
    • Third-party actions, including service partners, property sellers, buyers, agents, or government authorities
    • AI-generated content errors or misinterpretation
    • Payment processing failures, refund disputes, or financial transaction issues
    • Violations of law by third parties or government data inaccuracies

EVEN IF Verified.RealEstate has been advised of the possibility of such damages, or such damages were reasonably foreseeable.

ACKNOWLEDGMENT: You acknowledge that this limitation of liability reflects a reasonable allocation of risk and is a fundamental element of the basis of the bargain between you and Verified.RealEstate. The services would not be provided without these limitations.

AGGREGATE LIABILITY CAP:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIFIED.REALESTATE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE PLATFORM, OR SERVICES (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) SHALL NOT EXCEED THE LESSER OF:

  • (i) The total fees actually paid by you to Verified.RealEstate (excluding payment gateway charges, taxes, and third-party service provider fees) in the six (6) months immediately preceding the event giving rise to liability; OR
  • (ii) INR 50,000 (Indian Rupees Fifty Thousand)

WHICHEVER IS LESS.

SPECIAL PROVISIONS:

  • If you have not paid any fees to Verified.RealEstate (e.g., using free services or tools), our total liability shall be limited to INR 0 (ZERO).
  • This cap applies cumulatively to all claims and shall not be increased by multiple claims or incidents.
  • This liability cap applies regardless of the legal theory, cause of action, or forum.
  • Third-Party Service Liability: For services provided by third-party partners (construction, legal, architectural, etc.), our liability is limited to the commission/fee we earned from that specific transaction, and shall NOT include the total service value.
  • Referral Commission Claims: For disputes regarding referral commissions, our liability is limited to the specific commission amount in dispute.

JURISDICTIONAL VARIATIONS: Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages (death, personal injury, fraud, gross negligence). In such jurisdictions, our liability will be limited to the minimum extent permitted by applicable law.

MULTIPLE CLAIMANTS: If multiple parties claim rights arising from the same transaction or service order, the aggregate liability cap applies to all claimants collectively, not individually.

Indemnification

INDEMNIFICATION OBLIGATIONS:

You agree to indemnify, defend, and hold harmless Verified.RealEstate, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, service providers, partners, licensors, and representatives (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, settlements, costs, and expenses (including reasonable attorneys' fees, expert fees, court costs, and litigation expenses) arising out of or related to:

  • (a) Your use or misuse of the platform, services, content, or tools
  • (b) Your violation of these Terms, Privacy Policy, Refund Policy, or any applicable law or regulation
  • (c) Your violation of any third-party rights, including intellectual property rights, privacy rights, publicity rights, or contractual rights
  • (d) Any content, information, data, property listings, or materials you submit, post, or transmit through the platform
  • (e) Any false, inaccurate, misleading, or fraudulent information you provide
  • (f) Your property transactions, dealings with other users, service providers, buyers, sellers, or third parties facilitated through the platform
  • (g) Any property defects, title issues, legal problems, regulatory violations, or encumbrances related to properties you list, buy, sell, or transact
  • (h) Your breach of any representation or warranty made to Verified.RealEstate
  • (i) Any negligent, willful, or unlawful conduct by you or anyone acting on your behalf
  • (j) Tax liabilities, penalties, or obligations arising from your transactions or referral earnings
  • (k) Disputes with other users, service partners, or third parties
  • (l) Your failure to comply with RERA, CMDA, municipal laws, environmental regulations, or other applicable real estate laws

DEFENSE OBLIGATIONS: Upon Verified.RealEstate's request, you will: (i) assume full control of the defense and settlement of any indemnified claim (provided you obtain Verified.RealEstate's prior written consent for any settlement); (ii) cooperate fully with Verified.RealEstate in the defense; (iii) not settle any claim in a manner that imposes liability or obligations on Verified.RealEstate without our prior written consent.

RIGHT TO PARTICIPATE: Verified.RealEstate reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification, without waiving any of your indemnification obligations.

SURVIVAL: This indemnification obligation will survive termination of your account, these Terms, or your use of the platform.

Termination of Services

We reserve the right to terminate or suspend your access to our services for any reason, including but not limited to violations of these Terms, failure to make timely payments, or engagement in illegal activities.

You may discontinue the use of our services at any time by terminating your account. Upon termination, any outstanding fees or charges shall remain payable.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes or legal actions arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.

For disputes that cannot be resolved through negotiations, users agree to first attempt mediation or arbitration before pursuing legal action. The arbitration process will be conducted under the rules of the Indian Arbitration and Conciliation Act.

Referral Terms

  • The referral commission is based on the type of service availed and follows a structured percentage model.
  • If the session cookie is available at the time of order placement, the referrer will earn the full commission percentage as mentioned in the table below.
  • If the session cookie is not available, the commission is reduced to half of the respective percentage.
  • The session cookie remains valid for 1 week from the time the referral link is clicked.

How Chain Referral Commission Works:

  • Referral commission decreases exponentially in chain referrals.
  • If a user was originally referred by one person but later places an order through another user’s referral link, the latest referrer will receive the commission.
  • Future commissions will also be attributed to the most recent referrer.

  • Any misuse of the referral system (e.g., self-referrals, fake accounts, fraudulent transactions) will result in cancellation of referral earnings.
  • Verified.RealEstate reserves the right to block users from further participation in the referral program.
  • Legal action may be taken if fraudulent activities are detected.
Assumption of Risk

CRITICAL ACKNOWLEDGMENT - PLEASE READ CAREFULLY:

BY USING THIS PLATFORM AND SERVICES, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH:

1. REAL ESTATE TRANSACTION RISKS:

  • All risks inherent in real estate transactions, including but not limited to property defects, title issues, encumbrances, liens, legal disputes, boundary disputes, survey errors
  • Risks of inaccurate property valuations, market fluctuations, investment losses, financing failures
  • Risks related to property condition, structural integrity, environmental contamination, zoning violations, building code violations
  • Risks of fraudulent sellers, forged documents, misrepresentation by sellers or agents
  • Risk that properties listed may not match descriptions, photographs, or representations

2. VERIFICATION SERVICE RISKS:

  • Risk that verification reports, EC reports, Patta analysis, or property checks may contain errors, omissions, inaccuracies, or be based on outdated or incomplete government data
  • Risk that AI-powered analysis tools may produce incorrect, incomplete, or misleading results
  • Risk that title defects, legal issues, or encumbrances may exist despite verification services
  • Risk that verification services do not constitute legal advice or guarantee clear title or property legality
  • Risk that government records (RERA, CMDA, SRO) may be inaccurate, outdated, incomplete, or inaccessible

3. SERVICE PARTNER & THIRD-PARTY RISKS:

  • All risks associated with service providers, contractors, legal professionals, architects, engineers, and other third-party partners engaged through our platform
  • Risks of service partner incompetence, negligence, misconduct, fraud, or failure to deliver services
  • Risks of disputes with service providers, quality issues, timeline delays, cost overruns
  • Risk that we do not verify, warrant, guarantee, or control the qualifications, competence, or actions of service partners

4. PLATFORM & TECHNOLOGY RISKS:

  • Risks of platform downtime, unavailability, errors, bugs, security vulnerabilities, data loss
  • Risks of unauthorized access to your account, data breaches, cyber-attacks, hacking
  • Risks associated with third-party service provider failures, including payment gateways, cloud services, AI providers, communication platforms
  • Risk that platform features, content, or tools may be inaccurate, unreliable, or unsuitable for your purposes
  • Risk of loss of data, documents, communications, or transaction history

5. FINANCIAL & PAYMENT RISKS:

  • Risks associated with payments, refunds, escrow transactions, commission payments, subscription charges
  • Risks of payment processing failures, delays, chargebacks, fraud
  • Risk that refunds may be denied, delayed, or subject to deductions
  • Risks associated with referral earnings, commission calculations, payout delays

6. LEGAL & REGULATORY RISKS:

  • Risks of changes in laws, regulations, RERA rules, CMDA regulations, stamp duty, GST, property laws
  • Risks of non-compliance with applicable laws, permits, approvals, licenses
  • Risks of litigation, disputes, claims, penalties, fines related to property transactions
  • Risk that information provided is not legal advice and may not reflect current laws

7. FORCE MAJEURE & UNCONTROLLABLE EVENT RISKS:

  • All risks arising from natural disasters, pandemics, government actions, strikes, wars, terrorism, riots, technical failures, third-party failures, or any events beyond our control
  • Risks of service delays, interruptions, or non-delivery due to force majeure events

EXPLICIT ACKNOWLEDGMENTS:

YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT:

  • YOU ARE SOLELY RESPONSIBLE for evaluating all risks before using our services or engaging in any property transactions
  • YOU HAVE NOT RELIED exclusively on information provided by Verified.RealEstate and have conducted (or had the opportunity to conduct) your own independent due diligence
  • YOU ACCEPT ALL CONSEQUENCES of your use of the platform and services, whether favorable or unfavorable
  • YOU SHOULD CONSULT PROFESSIONALS (lawyers, chartered accountants, engineers, architects) before making any property-related decisions
  • REAL ESTATE INVOLVES INHERENT RISKS that cannot be eliminated, and you voluntarily assume all such risks
  • WE HAVE MADE NO GUARANTEES regarding outcomes, results, accuracy of information, suitability of properties, or success of transactions

WAIVER OF CLAIMS: By assuming these risks, you waive any right to claim that you were not adequately warned or informed of the risks associated with using our platform and services.

IF YOU DO NOT ACCEPT THESE RISKS, DO NOT USE OUR PLATFORM OR SERVICES.

Force Majeure

ZERO LIABILITY FOR FORCE MAJEURE:

Verified.RealEstate shall have ABSOLUTELY ZERO LIABILITY for any failure, delay, interruption, or non-performance of obligations, or for any loss or damage of any kind resulting from events beyond our reasonable control ("Force Majeure Events"), including but not limited to:

  • Natural Disasters & Acts of God: Earthquakes, floods, tsunamis, cyclones, hurricanes, storms, droughts, fires, pandemics, epidemics, health emergencies, or any natural calamities
  • Government & Regulatory Actions: Laws, regulations, orders, notifications, lockdowns, curfews, emergency declarations, license suspensions, office closures, strikes, bandhs, government mandates
  • Regulatory & Legal Changes: Changes in RERA regulations, CMDA rules, SRO procedures, stamp duty laws, property laws, tax laws, GST, data protection laws, or ANY applicable regulations or legal requirements
  • Political, Civil & Military Events: War, invasion, acts of foreign enemies, terrorism, riots, civil unrest, rebellion, revolution, insurrection, military actions, political instability, coups
  • Labor & Industrial Issues: Strikes, lockouts, labor disputes, work stoppages, shortage of labor, shortage of materials or supplies
  • Technical & Infrastructure Failures: Internet outages, power failures, telecommunications failures, server failures, hosting failures, network failures, infrastructure collapses
  • Cyber Security Events: Cyber-attacks, DDoS attacks, hacking attempts, malware, viruses, ransomware, data breaches by third parties, unauthorized access by malicious actors
  • Third-Party Service Provider Failures: Failure, breach, delay, interruption, or non-performance by ANY payment gateways, AI service providers, cloud infrastructure providers, database providers, communication platforms, project management tools, authentication services, or ANY other third-party service providers, vendors, contractors, banks, financial institutions, government departments, or third parties we rely upon
  • Government Department Issues: SRO closures or delays, CMDA delays, municipal delays, court delays, registry delays, document processing delays, bureaucratic delays, or delays by ANY government authority or department
  • Transportation & Supply Chain: Transportation disruptions, supply chain failures, logistics failures, shipping delays, cargo delays
  • Economic & Financial Events: Economic collapse, recession, depression, currency failures, exchange rate fluctuations, banking crises, financial system failures, market disruptions, credit crunches
  • Utility & Service Disruptions: Failures or interruptions of electricity, water, telecommunications, internet, or any essential utility or service
  • ANY AND ALL OTHER CAUSES: Any other circumstances, events, causes, or conditions whatsoever beyond Verified.RealEstate's reasonable control, whether or not foreseeable, whether or not similar to those enumerated above

EFFECT OF FORCE MAJEURE:

  • Our performance obligations shall be suspended for the duration of the Force Majeure Event
  • Deadlines and timelines shall be extended by the duration of the Force Majeure Event plus a reasonable resumption period
  • We shall NOT be liable for any delays, non-performance, losses, damages, or costs arising from Force Majeure Events
  • You remain obligated to pay all fees for services ordered, regardless of Force Majeure delays
  • NO REFUNDS will be issued for delays or non-performance caused by Force Majeure Events

TERMINATION RIGHTS: If a Force Majeure Event continues for more than sixty (60) days, either party may terminate the affected service order without liability, except that you remain liable for fees for work already performed.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
