1.2. By accessing or using LandLens services, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

1.3. This policy covers information collected through our website, mobile applications, APIs, and any other services we provide.

1.4. We are committed to protecting your privacy and ensuring compliance with applicable data protection laws, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other relevant Indian data protection regulations.

1.5. For users accessing our services from the European Union, we also endeavor to comply with the General Data Protection Regulation (GDPR) requirements.

3.4. OCR and AI Processing: Our platform uses Optical Character Recognition (OCR) and Artificial Intelligence to:

  • Extract text and data from uploaded documents
  • Analyze document authenticity and completeness
  • Cross-reference information across multiple sources
  • Generate automated insights and risk assessments

3.5. Statutory Public Registers: A substantial part of our platform reproduces records from public registers which the concerned authority is required by law to publish for public viewing — including the Tamil Nadu Real Estate Regulatory Authority (TNRERA) register of projects, promoters and agents, maintained under Section 34(b) of the Real Estate (Regulation and Development) Act, 2016, together with CMDA, DTCP and Registration Department records. Such entries may contain particulars relating to identifiable individuals, including promoters, landowners, licensed surveyors and architects.

3.6. Basis on Which Register Data Is Held: This information is not collected from those individuals and is not processed on the basis of their consent. Section 3(c)(ii) of the Digital Personal Data Protection Act, 2023 provides that the Act does not apply to personal data made publicly available by the Data Principal, or by any other person under an obligation under any law in force in India to make such personal data publicly available. Personal data appearing in these statutory registers falls within that provision. The authority concerned, and not Verified.RealEstate, is the source and custodian of record; any correction to an entry must be sought from that authority.

3.7. Contact Masking and Removal Requests: As a discretionary measure, and without accepting any obligation to do so, we mask direct personal contact details (mobile numbers, email addresses, PAN numbers and door-level address identifiers) appearing in reproduced register entries, while retaining registration numbers, survey numbers, locality and other substantive record particulars that the register exists to make public. Requests for further removal or masking will be reviewed and may be actioned at our sole discretion as a goodwill measure; no undertaking is given as to any outcome, and any such action is not an admission of unlawful processing. Masking applied by us affects this platform only and cannot alter the entry on the authority's own portal or on any search engine, cache, archive or third-party service. Removal from the statutory register itself may only be sought from the authority maintaining it. We retain the record as published in unmodified form for compliance, audit and the establishment or defence of legal claims. Requests may be addressed to the Grievance Officer named in Section 17 below.

4. Purpose of Data Collection

4.1. Service Delivery: We use your information to:

8. Data Retention

8.1. Retention Periods:

  • Account Information: Retained for the duration of your account plus 7 years after closure for legal compliance
  • Transaction Records: Retained for 8 years as per Indian tax and accounting requirements
  • Property Reports: Retained for 7 years from generation date
  • Uploaded Documents: Processed and deleted within 90 days unless retention is requested
  • Communication Logs: Retained for 3 years
  • Technical Logs: Retained for 1 year

8.2. Extended Retention: We may retain data longer if:

  • Required by applicable law or regulation
  • Necessary for legal proceedings or disputes
  • Required for audit or compliance purposes
  • Requested by you for your records

8.3. Deletion: Upon expiration of retention periods, data is securely deleted or anonymized for statistical purposes.

9. Your Rights and Choices

9.0. Scope of This Section: The rights set out below apply to personal data we collect from you in the course of providing our services. They do not extend to information reproduced from statutory public registers, which is governed by Sections 3.5 to 3.7 above and which falls outside the Digital Personal Data Protection Act, 2023 by virtue of Section 3(c)(ii) of that Act. Requests concerning public-register entries are handled under Section 3.7, on a discretionary basis.

9.1. Access Right: You have the right to request a copy of the personal information we hold about you.

9.2. Rectification Right: You can request correction of inaccurate or incomplete personal information.

9.3. Erasure Right: You may request deletion of your personal data, subject to legal retention requirements, and excluding information reproduced from statutory public registers as described in Sections 3.5 to 3.7.

9.4. Restriction Right: You can request limitation of processing in certain circumstances.

9.5. Portability Right: You have the right to receive your data in a structured, machine-readable format.

9.6. Objection Right: You may object to processing based on legitimate interests or for direct marketing.

9.7. Consent Withdrawal: Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.

15.2. Human Oversight: Our AI-generated insights are designed to assist human decision-making, not replace it. All critical assessments can be reviewed by our team upon request.

15.3. Right to Explanation: You have the right to request an explanation of any automated decision that significantly affects you.

15.4. Model Training: Anonymized and aggregated data may be used to improve our AI models. Individual document content is not used for training without explicit consent.

16. Changes to This Privacy Policy

16.1. We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.
