Cross-Border Data Transfers: Some of our service providers may process data outside India. We ensure such transfers comply with applicable data protection laws and implement appropriate safeguards including standard contractual clauses where required.

- Service Orders & Documents: Seven (7) years or as required by applicable real estate and legal regulations
- Payment Records: As required by payment regulations and tax laws, typically seven (7) years
- Marketing Communications: Until you withdraw consent or unsubscribe, whichever is earlier
- Session & Cookie Data: As specified in our cookie settings (typically 1 week for referral tracking, up to 1 year for functional cookies)
After the retention period expires, we will securely delete, destroy, or anonymize your personal data unless retention is required by law. Upon your request for data deletion, we will comply within thirty (30) days, subject to legal retention requirements.
Under India's DPDPA and applicable laws, you have the following rights:

Security Measures We Implement:

Data Breach Notification: In the event of a data breach that poses a risk to your rights, we will notify you and the applicable Data Protection Board within seventy-two (72) hours of becoming aware of the breach, in compliance with DPDPA requirements. The notification will include the nature, scope, and impact of the breach, along with steps taken to mitigate harm.

- Verified.RealEstate shall have ZERO LIABILITY for any indirect, incidental, consequential, special, or punitive damages arising from or related to: (a) any data breach caused by third-party service providers, hackers, malicious actors, or any cause whatsoever beyond our reasonable control; (b) unauthorized access to your data regardless of cause; (c) loss of data, profits, goodwill, or business opportunities resulting from privacy incidents of any nature.
- MAXIMUM AGGREGATE LIABILITY CAP: In the unlikely event a court determines we have any liability whatsoever, our total aggregate liability for ALL claims arising out of data processing or privacy violations shall be strictly limited to the lesser of: (i) the total fees paid by you to Verified.RealEstate in the six (6) months preceding the incident, OR (ii) INR 50,000 (Fifty Thousand Rupees), OR (iii) if you paid no fees, ZERO (₹0).
- ZERO LIABILITY FOR: We have ZERO liability for data breaches or privacy incidents resulting from: (a) acts of God, force majeure, natural disasters, war, terrorism, or government actions; (b) your own negligence, including sharing passwords, failing to secure your account, or falling victim to phishing or social engineering; (c) failures, breaches, or actions of ANY third-party service providers, payment gateways, cloud providers, communication platforms, or technology vendors; (d) internet service disruptions, cyber attacks, hacking, distributed denial of service (DDoS) attacks, malware, ransomware, or any malicious activities; (e) vulnerabilities in third-party software, plugins, platforms, or systems we do not directly control; (f) regulatory changes or government-mandated data disclosures; (g) ANY OTHER CAUSE WHATSOEVER.
- Third-Party Services - ZERO LIABILITY: Data processed by ANY of our third-party service providers (including payment processors, AI providers, database providers, communication platforms, analytics services, and any other vendors) is subject to their respective privacy policies and terms. WE HAVE ZERO LIABILITY for their data handling practices, security breaches, privacy violations, or any actions or omissions by third parties. You acknowledge, accept, and consent to all third-party data processing and assume all risks associated therewith.
- No Guarantee of Security - USE AT YOUR OWN RISK: While we implement commercially reasonable security measures, we make ABSOLUTELY NO WARRANTY, GUARANTEE, OR REPRESENTATION (expressed or implied, statutory or otherwise) regarding the absolute security, confidentiality, or integrity of your data. YOU USE OUR SERVICES ENTIRELY AT YOUR OWN RISK AND ASSUME ALL RISKS ASSOCIATED WITH DATA PROCESSING.
- YOU ASSUME ALL RISKS: By using our services, you expressly assume all risks related to data privacy, security breaches, unauthorized access, data loss, and any other privacy-related matters.
Indemnification: You agree to indemnify, defend, and hold completely harmless Verified.RealEstate, its officers, directors, employees, affiliates, service providers, and representatives from ANY AND ALL claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) your violation of this Privacy Policy; (ii) your use or misuse of our platform or services; (iii) your violation of any third-party rights; (iv) any data you provide that is inaccurate, fraudulent, or misleading; (v) any breach or alleged breach of data protection laws by you; (vi) any claims related to data processing or privacy.
FINAL DISCLAIMER: This limitation of liability applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and applies even if Verified.RealEstate has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the minimum extent permitted by applicable law.
