What the government order changes

G.O.Ms.No.163 of the Housing and Urban Development (UD I) Department substitutes Regulation 36 of the Development Regulations for the Chennai Metropolitan Area. The substituted regulation allows the Chennai Metropolitan Development Authority to grant Premium FSI over the normally allowable FSI, subject to a maximum of 1, applicable road width limits, notified areas, approved guidelines and payment of the prescribed charge.

The Premium FSI guidelines apply in the Chennai Metropolitan Area, except the Red Hills catchment area restricted for development and water body areas maintained by the Chennai Metropolitan Water Supply and Sewerage Board for drinking water purposes.

Premium FSI based on road width

The Premium FSI available is calculated as a percentage of the normally allowable FSI:

  • Roads 18 metres and above: 40 per cent.
  • Roads from 12 metres to below 18 metres: 30 per cent.
  • Roads from 9 metres to below 12 metres: 20 per cent.

The guidelines do not provide a Premium FSI percentage for roads below 9 metres wide.

How the charge is calculated and paid

The Premium FSI benefit is related to the proportionate land extent needed for the additional floor area. The guidelines give these examples:

  • Where normal permissible FSI is 1.50, each additional square metre of floor area corresponds to 0.66 square metre of proportionate land.
  • Where normal permissible FSI ranges from 2.0 to 2.50, each additional square metre corresponds to proportionate land ranging from 0.50 to 0.40 square metre respectively.

The Premium FSI charge equals the cost of that proportionate land, using the Registration Department guideline value. The applicant must pay the charge to the Chennai Metropolitan Development Authority in one lump sum before receiving planning permission.

Who is affected

Property owners and developers seeking additional floor area through Premium FSI must have absolute rights over the property. Retention of an undivided share of land is not recognised for granting Premium FSI.

The applicant must state the intention to use Premium FSI when filing the planning permission application and undertake to pay the charge before permission is granted. Amounts collected must be placed in a separately allotted Government account and used for area infrastructure development as directed by the Government.
