What the amendments govern

The amendments notified by the Housing and Urban Development Department apply to the regularisation of unapproved plots, layouts and subdivisions in Tamil Nadu. They affect individual plot holders, layout promoters, registered cooperative societies, associations of plot owners, competent authorities and local authorities.

The prescribed period for applying was extended from six months to one year. Where listed layouts have no regularisation application, the competent authority must prepare and approve the layout framework as it exists on the ground, subject to changes needed for connections to adjoining land.

Eligibility and site requirements

Key provisions include:

  • A plot must abut a public street or have access from a public street through a private street over which the applicant has a right of access.
  • Individual plots already sold in a layout or subdivision receive full exemption from Open Space Reservation requirements.
  • If at least one plot in an unapproved layout has been sold, its internal roads are regularised on an "as is where is" basis.
  • Open Space Reservation land must be created by combining or altering unsold plots, to an extent of at least 10 per cent of the total unsold plot area. It need not be one continuous parcel or have fixed dimensions.
  • Roads and Open Space Reservation areas shown in the approved layout framework are treated as vested in the local authority.

Plots covered by earlier government regularisation schemes are treated as regularised for residential use, regardless of the land use zone. Certain older layouts are treated as approved. Other unauthorised layouts and subdivisions formed up to 20th October 2016 are eligible within the location-specific periods stated for the Chennai Metropolitan Area and urban and rural areas outside it.

Charges and payment

Development charge per square metre is Rs.500 in City Municipal Corporation areas, Rs.250 in Special and Selection Grade Municipal areas, Rs.150 in Grade I and Grade II Municipal areas, Rs.75 in Town Panchayat areas and Rs.25 in Village Panchayat areas. These amounts go to separate local authority accounts for basic infrastructure in the particular layout.

An applicant must pay the charges and fees in a demand notice within thirty days of communication. Late payment attracts interest at six per cent per year. If payment is not made within 90 days of receiving the demand notice, the application must be rejected.

Application documents

The substituted application forms require property, survey, registration, road and Open Space Reservation details. Applicants must also provide a self-assessment working sheet, a declaration concerning the two land ceiling laws identified in the form, and an undertaking to carry out required rectification works and pay assessed charges.

Common questions

Can a sold plot be regularised if the layout has no Open Space Reservation land?

An individual plot already sold in a layout or subdivision is given full exemption from Open Space Reservation requirements. For the wider layout, the required reservation is based on at least 10 per cent of the total area of unsold plots.

Does my plot need direct access to a public road?

The plot must either abut a public street or have access from one through a private street over which you have a right of access.

What happens if I do not pay the demand notice on time?

Payment is due within thirty days from communication of the demand notice, with interest at six per cent per year for delay. If the amount is not paid within 90 days from receipt of the notice, the application must be rejected.

Are plots regularised under an earlier government scheme still recognised?

Yes. Plots under earlier government regularisation schemes are treated as regularised for residential use, regardless of the land use zone in the relevant development plan.
