What the amendments govern

The Amendments to the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Rules, 2019 govern how a sub-tenancy must be reported to the Rent Authority. They were made under the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017.

The changes directly concern landlords and tenants who create a sub-tenancy. They also require information about the sub-tenant, the premises, any property manager, rent and other charges.

Main changes

The Housing and Urban Development Department amendments make the following changes:

  • Rule 6 is replaced. Every sub-tenancy must be informed to the Rent Authority jointly by the landlord and tenant, using Form III.
  • In rule 8, sub-rule (1), the reference to sections 10, 14, 15 and 20 is replaced by a reference to sections 10, 14, 15, 19 and 20.
  • In rule 10, a reference to sub-section (1) of section 22 is added after the reference to sub-section (2) of section 21.
  • The previous Form III is replaced with a revised form titled “Intimation of sub-tenancy”.

Information required in Form III

The revised Form III asks the landlord and tenant to provide:

  • The landlord's name and address.
  • The property manager's name and address, if any.
  • The tenant's name, address, email address and contact details.
  • The sub-tenant's name and address.
  • A description of the premises and any appurtenant land.
  • The date possession is given to the sub-tenant.
  • The duration of the sub-tenancy.
  • The rent payable.
  • Furniture and equipment provided.
  • Charges for electricity, water, extra furnishings, fittings, fixtures and other services.

Documents and declaration

Form III lists a supplementary agreement and a self-attested copy of the sub-tenant's identity proof as enclosures. The landlord and tenant must jointly declare that the supplementary agreement does not contradict the original lease or tenancy agreement, and both must sign the form.
