What the Gazette governs

Tamil Nadu Government Gazette No. 48, Part III, Section 1(a), dated 28 November 2018, contains two Labour and Employment Department amendments concerning annual returns and one Public Department amendment concerning medical allowance for former legislators. It does not contain provisions about land ownership, registration, planning permission or property transactions.

Contract labour annual returns

G.O. Ms. No. 143, Labour and Employment (H1), dated 25 October 2018, amends the Tamil Nadu Contract Labour (Regulation and Abolition) Rules, 1975. It affects principal employers who would otherwise send the annual return in Form No. XXV.

A principal employer need not send Form No. XXV if any one of these combined annual returns is furnished:

  • Form No. XIII under the Tamil Nadu Catering Establishments Rules, 1959.
  • Form No. XII under the Tamil Nadu Beedi and Cigar Workers (Conditions of Employment) Rules, 1968.
  • Form No. 28 under the Tamil Nadu Plantations Labour Rules, 1955.
  • Form No. XIX under the Tamil Nadu Motor Transport Workers' Rules, 1965.

Maternity benefit annual returns

G.O. Ms. No. 158, Labour and Employment (H2), dated 8 November 2018, amends the Tamil Nadu Maternity Benefit Rules, 1967. It affects employers who would otherwise send the annual return in Form K.

An employer need not send Form K if the employer furnishes one of the specified combined annual returns, namely Form No. XIII for catering establishments, Form No. XII for beedi and cigar workers, Form No. 28 for plantations labour, or Form No. XIX for motor transport workers.

Medical allowance for former legislators

G.O. Ms. No. 878, Public (Establishment.I & Legislature), dated 13 November 2018, amends the Tamil Nadu Legislators' (Medical Attendance and Treatment to Former Members) Rules, 1982.

The amendment:

  • Increases the medical allowance for former members from Rs.25,000 to Rs.30,000 for every financial year.
  • Makes the same amount change in the certificate under Form C in the Appendix.
  • Is deemed to have taken effect on 1 July 2018.

Relevance to property readers

Tamil Nadu property buyers, owners and property professionals are not directly affected in their land dealings by these amendments. Employers or principal employers covered by the named labour rules may, however, benefit from the removal of duplicate annual return filing.
