What the rules govern

The Tamil Nadu Non-Lapsable Road Safety Fund Rules, 2022 govern a dedicated fund intended to support road safety measures without delays associated with conventional funding mechanisms. The fund supports the goal of an accident free Tamil Nadu by 2030 and covers road engineering, traffic enforcement, emergency care and public awareness.

For property buyers and owners, the rules do not establish requirements for land ownership, registration, building approval or land use. Their relevance is mainly indirect, through road infrastructure improvements and accident prevention measures in local areas.

How the fund is financed and managed

The Tamil Nadu Non-Lapsable Road Safety Fund may receive money from:

  • Grants from the State Government.
  • Grants from the Ministry of Road Transport and Highways, international organisations, Corporate Social Responsibility sources and other non-profit organisations for road safety.
  • Transfer of 50 per cent of compounding fees collected under the Motor Vehicles Rules and spot fines collected by the Police and Transport Department.

The Transport Commissioner or Road Safety Commissioner is the controlling authority. An Inter Departmental Committee on Road Safety Fund administers the fund. The committee must meet once every six months or when required, with a quorum of at least four members.

Activities eligible for support

Eligible proposals include:

  • Road infrastructure improvements, barricades, cones and traffic calming equipment.
  • Remedies for accident prone locations, with preference for locations recorded through the Integrated Road Accident Database and discussed by District Road Safety Committees.
  • Traffic education parks, exhibitions, advertisements, digital and print campaigns, and student competitions.
  • Road safety clubs in schools and annual road safety week or month activities.
  • Training for drivers, traffic police, paramedical personnel and road users.
  • Accident studies, traffic and accident data analysis, and related computer purchase and maintenance.
  • Innovative projects and approved road safety proposals from Village Panchayats.

State level road safety proposals receive top priority.

Proposal and accountability requirements

District and stakeholder department proposals ordinarily require approval from the relevant District Road Safety Committee before submission through the Head of Department. State level proposals may be submitted directly by the Head of Department.

Proposals cannot duplicate funding claimed under another scheme and must relate to road safety. Departments must report pending works periodically, submit utilisation certificates, maintain transparent accounts and return unspent amounts before the end of the financial year. New proposals are considered only after utilisation certificates for earlier funding have been received.

Common questions

Do these rules change my land ownership or property registration requirements?

No property ownership, registration, building approval or land use requirements are set out. The rules govern funding for road safety measures and related activities.

Can a Village Panchayat seek money for a local road safety improvement?

Yes. Village Panchayat road safety proposals are to be encouraged and sent to the Transport Commissioner or Road Safety Commissioner after approval by the relevant District Road Safety Committee.

Which accident locations receive preference for remedial work?

Preference is given to accident locations captured in the Integrated Road Accident Database and discussed in District Road Safety Committee meetings.

Can a department obtain Road Safety Fund money for a project already funded elsewhere?

No. A stakeholder department cannot claim funding for a project already funded through another scheme, and its proposal must certify that funding has not been claimed from another source.
