What the notification changes

The Housing and Urban Development Department issued Government Order (Ms.) No. 132, Housing and Urban Development [HB3(1)], dated 9 September 2025. The Governor of Tamil Nadu made these amendments using powers under the Tamil Nadu Apartment Ownership Act, 2022.

The notification amends the Tamil Nadu Apartment Ownership Rules, 2024 rather than replacing them. It applies to apartment owners, apartment owner associations, existing societies, boards of managers and competent authorities dealing with registration and records.

Association governance

The amended Tamil Nadu Apartment Ownership Rules, 2024 make the following governance changes:

  • An association must make bye-laws that are consistent with the Act and the rules. The earlier wording requiring bye-laws on the lines of the model bye-laws in the Appendix is replaced.
  • A board of managers must have at least three apartment owners as members.
  • The corresponding model bye-law for the board of managers is also changed to require at least three members.
  • A voting item in the model bye-laws is removed.

Changing an association's name

An apartment association or existing society seeking a name change must apply to the competent authority. The application requires consent from at least two-thirds of the apartment owners through an extraordinary resolution passed at a special general meeting.

The competent authority may approve or refuse the application. A refusal must contain written reasons and must be communicated to the applicant. If approved, the new name is entered in the register and a fresh registration certificate is issued. The name change becomes complete and effective only when that certificate is issued.

Register of members

Every association and existing society must maintain a register containing each member's name, address and occupation.

  • A copy must be filed with the competent authority within one month from registration under the applicable registration provision.
  • Changes to the register must be notified to the competent authority within three months from the date of the change.

Changes to prescribed forms

The amendments revise Form A to include apartment, owner, use, carpet area, UDS and percentage of undivided interest information. They remove wording about proportionate representation for voting, correct a Form-I enclosure reference, and add a column for proportionate common areas to Form-L.
