What the government order does

Government Order G.O.Ms.No. 13, Industries (SIPCOT-LA), dated 21st February 2018, was issued by the Industries Department, Government of Tamil Nadu, and published in the Tamil Nadu Government Gazette Extraordinary on 2nd March 2018. It provides a method for determining the final compensation award in certain industrial land acquisition cases.

The method follows the First Schedule of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It uses multiplier factors based on whether the project is in an urban or rural area and, for rural projects, the distance from an urban area.

Who is affected

Government Order G.O.Ms.No. 13 affects landowners whose land was acquired under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, where interim compensation had already been fixed and allowed under Government Order G.O. (Ms.) No.45, Industries (SIPCOT-LA) Department, dated 14th May 2014.

It is relevant when the authorities determine the final award payable to those landowners. The source also records that compensation provisions under the 2013 central legislation had been applied to industrial acquisition cases where the notice under the Tamil Nadu industrial land acquisition legislation was published on or after 1st January 2014.

Multiplier factors

For final compensation, market value is multiplied as follows:

  • Rural project within 30 kilometres of an urban area: 1.25.
  • Rural project beyond 30 kilometres and within 50 kilometres of an urban area: 1.50.
  • Rural project beyond 50 kilometres from an urban area: 2.00.
  • Project in an urban area: 1.

Meaning of urban area

Government Order G.O.Ms.No. 13 treats the following as urban areas:

  • Areas, including village panchayats, within the territorial limits of the Chennai Metropolitan Development Authority.
  • Madurai, Tiruchirappalli, Salem, Coimbatore and Tirunelveli Municipal Corporations, together with areas, including village panchayats, within 8 kilometres of their limits.
  • All other Municipal Corporations, Municipalities, Town Panchayats, Cantonments and Townships.
  • Any other area later notified as urban by the State Government.

The authorities must also use the instructions issued by the Additional Chief Secretary and Commissioner of Land Administration for guidance when determining market value.
