What the guidelines govern

Government Order (Ms.) No. 128, issued by the Housing and Urban Development Department on 20 September 2023, sets implementation guidelines for the Tamil Nadu Housing Board's allotment of plots, houses and flats. It follows Government Order (Ms.) No. 88 dated 28 July 2023, which introduced allotment on a first come, first served basis.

The Managing Director of the Tamil Nadu Housing Board is directed to follow these guidelines without fail.

Applications and allotment

Government Order (Ms.) No. 128 requires the Tamil Nadu Housing Board to manage applications as follows:

  • For plotted developments, an application notice must be issued as soon as the scheme is ready.
  • For houses, the notice inviting applications must be issued when the civil work is completed. Applicants can then inspect and select houses while the remaining work is being completed.
  • The notice may permit online applications on payment of 5 per cent of the total price.
  • Priority may be given to the person who applies first.
  • Existing rules on the percentage allotted under the community reservation system continue to apply.

After applications have been invited once, any houses or plots left unsold in that scheme may be purchased by anyone during the same financial year at the price fixed for that financial year.

Pricing rules

Government Order (Ms.) No. 128 requires prices for the next financial year to be fixed during the final two months of each financial year so that sales can continue without interruption.

  • A tentative price may be fixed where a final cost cannot be determined because of a court case or similar reason.
  • After the court issues its order, the final price must be fixed without delay by including the amount payable under the judgment and the cost of the case.
  • Where there is no pending court case or other problem, the final cost must be fixed and disclosed when applications are invited.
  • The final price must be based on the price applicable on the date the allottee pays the full amount. A later year's price cannot be applied merely because the sale deed is issued in that later year.

Delayed possession

Government Order (Ms.) No. 128 requires the Tamil Nadu Housing Board to set a completion period for houses and fix the price accordingly. If the Board does not hand over a house by the specified date, it cannot collect interest from the allottee for the period after that date.
