What the circular changes

Circular No. 25735/C1/2017, dated 8 June 2017, introduces revised market value guidelines for all village survey fields, streets and localities in the 50 registration districts of Tamil Nadu. From 9 June 2017, the revised value is 67% of the value shown on the Registration Department website on 8 June 2017.

The revised figures must be rounded as follows:

  • Square metre values are rounded up to the next 5 rupees.
  • Hectare values are rounded up to the next 500 rupees.

The reduced guideline applies to all types of documents presented for registration from 9 June 2017, subject to the rule concerning an existing agreement.

Registration fee increase

Circular No. 25735/C1/2017 raises the registration fee from 1% to 4% only for these four document types:

  • Conveyance.
  • Exchange.
  • Gift.
  • Settlement in favour of a person who is not a family member.

The higher registration fee applies from 9 June 2017. The source does not extend the increase to other document types.

Valuation of documents and property

Tamil Nadu registration officers must use the guideline value applicable on the date a document is presented. If the document shows a lower value, valuation proceedings must be based on the guideline in force on that filing date.

For documents presented on or after 9 June 2017:

  • Earlier high values recorded for the same property must not automatically be used.
  • Values fixed in older proceedings must not by themselves support action for undervaluation.
  • Registration statistics or surrounding values from before 9 June 2017 must not be used to fix a higher value.
  • Higher values arising after 9 June 2017 may be considered under the applicable departmental instructions.

For buildings, officers must not insist on the building value stated in an earlier document. A value based on the current Public Works Department schedule is sufficient.

Existing agreements and pending cases

An active agreement showing a value higher than the revised guideline must be treated as the market value. If that agreement has been cancelled, officers must not insist on its value, even where the parties remain the same.

Documents registered or presented on or before 8 June 2017 and still pending for valuation must be handled using the old guideline value. For registrations from 9 June 2017 to 13 June 2017, Sub-Registrars were permitted to collect stamp duty and registration fees in cash without a maximum limit.
