Scope and authority

G.O.(Ms) No.324 of the Revenue and Disaster Management Department applies to every birth or death in Tamil Nadu that was not registered within one year. The applicant must approach the Revenue Divisional Officer for the area where the birth or death occurred and state why late registration is required.

A Judicial Magistrate or Metropolitan Magistrate order issued after 25 January 2017 is not valid for late registration. If such an order was issued before that date, the Revenue Divisional Officer must issue a fresh order without another enquiry, based on the earlier order.

Documents required

An application under G.O.(Ms) No.324 must include:

  • An affidavit carrying a court fee stamp of Rs.10.
  • A Non Availability Certificate for the year of occurrence, the preceding year and the succeeding year.
  • Available supporting identity and event records.
  • A written declaration accepting liability for prosecution if false information or documents are provided.

For a birth, supporting records may include school certificates, passport, driving licence, voter identity card, Aadhaar card, school extracts or hospital records. For a home birth, a statement from the head of the house, nearest relative or specified adult present may be used.

For a death, records may include identity documents, cremation or burial records, hospital records, or home death statements. For an accident, murder, suicide or a body found in a deserted place, the First Information Report and post-mortem report are required.

Non Availability Certificate

The Non Availability Certificate must be obtained from the jurisdictional Birth and Death Registrar through the authority listed for the place of occurrence. The listed authorities include the Tahsildar or Village Administrative Officer for a village panchayat, Executive Officer for a town panchayat or cantonment, and Commissioner for a municipality or corporation.

If a local body has been upgraded, converted or merged, the applicant must approach the authority responsible for its current classification.

Enquiry and decision

The Revenue Divisional Officer sends the details to the Village Administrative Officer, or the Revenue Inspector in Chennai District, for verification. The report moves through the Revenue Inspector and Tahsildar before returning to the Revenue Divisional Officer.

The applicant must publish the birth or death details in the local edition of regional newspapers. Objections may be submitted within 30 days of publication, and proof of publication must be produced at the enquiry. After examining the applicant and any required witnesses, the Revenue Divisional Officer may approve or reject registration and must decide within 60 days after receiving all required documents.
