What the rules govern

The Tamil Nadu Registration (Identity Verification for the Registration of Documents) Rules, 2018 govern the use of consent based Aadhaar authentication to verify people involved in registering documents. The Registration Department applies the rules only to Sub Registrar offices or other registration offices notified by the Inspector General of Registration from time to time.

The rules may affect anyone who presents a document for registration, appears before a Sub Registrar, or is examined in connection with registration. Use of the Aadhaar authentication facility is optional under the text.

Aadhaar identity verification

Notification Number SRO C-21/2018 provides the following process:

  • The person's explicit consent must be obtained electronically or on paper.
  • After consent, the twelve digit Aadhaar number and either a fingerprint scan or iris scan are entered into the Unique Identification Authority of India system through registration software.
  • A match using either the fingerprint or iris scan is sufficient.
  • The Unique Identification Authority of India system returns the consent based authentication data.
  • The authentication information and unique transaction code are printed in registration software summary reports and stored electronically.
  • Authentication information is treated as fulfilling the identification requirement for executants under the provisions identified in the notification.

When the identity of a person admitting execution has been verified through consent based Aadhaar authentication, the Registering Officer must not examine another person merely to satisfy himself about that party's identity. In other cases, the Registering Officer may examine Aadhaar authenticated persons and verify their details through the Unique Identification Authority of India system.

Iris scans and digital copies

Notification Number SRO C-22/2018 inserts rule 66-A into the existing registration rules. If a left thumb impression or another fingerprint cannot be obtained, the person's iris scan must be collected, stored electronically, and recorded in the endorsement on the document.

Notification Number SRO C-23/2018 inserts rule 147-A. For copies of entries in digitally stored books and indices, references to an application, seal, signature, and delivery may mean an online application, electronic seal, digital signature, and electronic delivery respectively.
